El desplazamiento en Colombia, un flagelo, un estado de cosas inconstitucionales

Abstract

Como aporte a la academia y para facilitar el estudio en torno al desplazamiento forzado, este artículo desarrolla de forma pedagógica una mirada al desplazamiento tanto en el ámbito Internacional como local. Expone la evolución normativa y las políticas de gobierno encaminadas atender esta problemática, dejando ver como dichas políticas se estructuraron desde las directrices de instituciones internacionales como Naciones Unidas y desde el rigor del Derecho Internacional Humanitario - DIH. El artículo toma como punto de referencia la sentencia del veintidós de enero de 2004 de la Corte Constitucional Colombiana, la cual marcó un hito frente a este
flagelo en el país al declararse el “estado de cosas inconstitucionales”.

ABSTRACT
As a contribution to the academy and to facilitate the study on the forced displacement, this article develops a pedagogical shift a look at both the international and local levels. Exposes regulatory developments and government policies designed to address this problem, showing how these policies were structured from the guidelines of international institutions like the United Nations and from the rigor of
international humanitarian law - IHL. The article takes as a benchmark the judgment of 22 January 2004 of the Colombian Constitutional Court, which was a landmark address this scourge in the country to declare the “state of unconstitutional things”.
